Terms and Conditions – Deuka Wear
Welcome to Deuka Wear. These Terms and Conditions govern your access to our website (https://deukawears.com/), communication channels, and all business transactions, custom manufacturing agreements, wholesale purchases, and OEM/ODM services provided by our factory. By engaging with our services, submitting custom designs, or placing an order, you agree to comply with and be bound by these terms. Please read them carefully before initiating any project or order.
1. General Provisions and Definitions
- “Company,” “We,” “Us,” or “Our”: Refers to Deuka Wear, operating out of our manufacturing facility in the Small Industrial Estate, Sialkot, Pakistan.
- “Client,” “You,” or “Your”: Refers to the individual, sports team, athletic organization, school district, retail brand, or B2B distributor placing an order or engaging our manufacturing services.
- “Products”: Refers to all custom athletic apparel, team uniforms, combat wear, streetwear, fitness gear, and accessories manufactured or supplied by Deuka Wear.
2. Quotations, Pricing, and Minimum Order Quantities (MOQs)
- Pricing Validity: All wholesale quotations and price estimates are provided based on current raw material costs, labor rates, and order volume projections. Quotations are valid for 30 days unless otherwise specified.
- Volume Tiers and MOQs: Deuka Wear offers structured volume pricing. Minimum Order Quantities (MOQs) apply to custom sublimated uniforms, private label apparel, and specialized production runs. Specific MOQs are established during the initial quotation phase based on product complexity.
- Currency and Taxes: All transactions are conducted in agreed-upon international currencies (typically USD). Clients are responsible for any local import duties, customs tariffs, value-added taxes (VAT), or sales taxes applicable in their destination country.
3. Custom Design, Tech Packs, and Approvals
- Client Responsibility: The client is entirely responsible for the accuracy of all submitted tech packs, vector artwork, color codes (Pantone/CMYK), logo files, spelling of team names, and roster numbering.
- Digital Proof Sign-Off: Prior to mass production, Deuka Wear provides digital mockups or physical pre-production samples for client review. Mass production will not commence until the client provides explicit written or digital approval of the final proofs.
- Color Variations: Due to differences in digital screen displays and fabric sublimation dye absorption, minor color variations between digital mockups and finished physical garments may occur and are considered within acceptable manufacturing tolerances.
4. Production Lead Times and Scheduling
- Estimated Timelines: Standard production lead times typically range from 2 to 4 weeks depending on order volume, seasonal demand, and design complexity. Lead times begin only after final proof approval and receipt of the required deposit or payment settlement.
- Force Majeure: Deuka Wear is not liable for production or shipping delays resulting from circumstances beyond our reasonable control, including natural disasters, utility failures, global freight disruptions, customs inspection holds, or labor strikes.
5. Payment Terms and Settlement
- Deposit Requirement: Custom manufacturing and wholesale orders require an agreed-upon initial deposit (typically 50%) before production commences.
- Final Balance: The remaining balance, including applicable shipping and freight costs, must be paid in full prior to final dispatch and export release of the goods from our facility, unless alternative B2B credit terms have been formally agreed upon in writing.
6. Global Shipping, Export, and Risk of Loss
- Shipping Modalities: We offer flexible shipping options, including expedited air freight, cost-effective ocean freight (FCL/LCL), and express courier services (DHL, FedEx, UPS).
- Incoterms and Risk: Shipping terms (such as FOB, CIF, or DDP) are defined per contract agreement. Unless otherwise specified under DDP terms, the risk of loss or damage to products passes to the client upon handover of the shipment to the carrier at the point of origin.
- Customs and Clearance: Clients are responsible for complying with local import regulations. While our logistics team provides full documentation (commercial invoices, packing lists, certificates of origin), final customs clearance is the responsibility of the client.
7. Quality Control, Returns, and Claim Policies
- Inspection Upon Receipt: Clients must inspect all shipments immediately upon delivery and report any manufacturing defects, quantitative discrepancies, or shipping damages within 7 business days of receipt.
- Defect Verification: Defective items must be documented with clear photographic or video evidence. Deuka Wear will review claims against our quality audit logs. Approved manufacturing defects will be repaired, replaced, or credited at our discretion.
- Custom Goods Exemption: Because all products are custom-manufactured to specific client tech packs, team rosters, and proprietary branding, we do not accept returns or issue refunds for buyer’s remorse, incorrect sizing chosen by the client, or errors present in client-approved digital proofs.
8. Intellectual Property and Brand Confidentiality
- Client IP Protection: Deuka Wear strictly respects client confidentiality. All submitted vector logos, custom sublimation patterns, and proprietary tech packs remain the exclusive intellectual property of the client and will not be shared or reproduced for third parties.
- Factory Designs and Catalogs: All proprietary catalog cuts, web design layouts, marketing text, and industrial manufacturing techniques developed by Deuka Wear remain our exclusive property.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Deuka Wear’s total liability for any claim arising out of or relating to product supply or manufacturing services shall not exceed the total monetary amount actually paid by the client for the specific order giving rise to the claim.
10. Modifications to Terms
Deuka Wear reserves the right to update or modify these Terms and Conditions at any time without prior notice. Continued engagement with our website or services constitutes acceptance of the most current version of these terms.
